1. Acceptance of Terms
By accessing or using the Rock Identifier website (rockidentifier.io) or mobile application (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Rock Identifier is an AI-powered tool that identifies rocks, crystals, minerals, gemstones, and fossils from photographs. Users upload or capture images, and the AI analyzes visual features to provide identification results including specimen name, classification, Mohs hardness, formation type, and estimated value range.
The Service is available via the website at rockidentifier.io and through mobile applications on iOS (App Store) and Android (download link).
3. Free Tier and Rate Limits
The web scanner at rockidentifier.io provides one free identification per day. The mobile app provides additional free scans per day. These limits may change at our discretion. Attempting to circumvent rate limits through automated tools, multiple accounts, IP manipulation, or any other method is a violation of these Terms.
4. Subscriptions and Payments
Rock Identifier offers optional paid subscriptions for unlimited identifications through the mobile app. Subscriptions are processed and managed through Apple (App Store) or Google (Google Play). By purchasing a subscription, you also agree to the payment terms of the applicable platform.
Subscription pricing, billing cycles, and cancellation policies are displayed in the app at the time of purchase. Refund requests should be directed to Apple or Google, as they process all payments. We do not have access to your payment information.
5. AI Accuracy Disclaimer
Rock Identifier provides AI-generated identifications for informational and educational purposes only. Results are not guaranteed to be accurate. The AI analyzes visual features from photographs and may produce incorrect, incomplete, or misleading identifications. Accuracy depends on photo quality, lighting, specimen condition, and the inherent limitations of visual analysis.
Specifically, the Service:
- Cannot perform physical tests (hardness, streak, acid reaction, specific gravity) that are often necessary for definitive identification.
- Cannot determine monetary value with precision. Value estimates are general ranges based on typical market conditions.
- Cannot certify, grade, or appraise gemstones, diamonds, or precious metals.
- Cannot determine gold karat purity, alloy composition, or authenticity of jewelry.
- May misidentify visually similar minerals (e.g., quartz vs. feldspar, pyrite vs. gold).
Do not rely on Rock Identifier for financial decisions, safety determinations, or professional geological assessments. For high-value specimens, formal identification, or any situation where accuracy is critical, consult a qualified geologist, gemologist, or mineralogist.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose.
- Upload images that are illegal, obscene, or violate the rights of others.
- Attempt to reverse-engineer, decompile, or extract the AI model or any proprietary technology.
- Use automated scripts, bots, or scraping tools to access the Service.
- Circumvent rate limits, security measures, or access controls.
- Interfere with or disrupt the Service or its infrastructure.
- Misrepresent AI-generated results as professional geological assessments or certified appraisals.
7. Intellectual Property
All content, design, code, AI models, and branding associated with Rock Identifier are the property of Rock Identifier or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written permission.
You retain ownership of any images you upload. By uploading an image, you grant us a limited, temporary license to process it solely for the purpose of generating your identification result. This license terminates when processing is complete and the image is discarded.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by law, Rock Identifier and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify, defend, and hold harmless Rock Identifier and its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Third-Party Services
The Service may contain links to third-party websites and services, including the Apple App Store, and Google Play Store. We are not responsible for the content, terms, or practices of third-party services. Your interactions with third parties are solely between you and that third party.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, discontinue use of the Service.
13. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
14. Termination
We may terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Delaware.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rock Identifier regarding the Service and supersede any prior agreements or communications.
